General Conditions of Sale

Article 1 – Scope of Application

These general conditions of sale apply to all transactions concluded through the websites of the Createc Designs network.

Any natural or legal person placing an order with Createc Designs via our secure payment platform is considered a "Client."

Article 1a – Age Limit

Age restrictions apply:

Artworks and digital products (prints, downloads): Clients must be over 16 years old.
Services (art courses, coaching, workshops, seminars): Clients must be over 18 years old.

We take steps to restrict access to our products and services to minors. Although the content of our work is not of a shocking nature, we prefer to serve a mature audience capable of understanding the responsibilities of collecting and investing in art.

Any newsletter subscriber under 16 years old will be immediately removed from our database once identified.
Any Client not meeting the age criteria will be refunded, and the product(s) concerned must be returned or access revoked.

Article 2 – Orders

Any order placed on a website belonging to Createc Designs implies full and unconditional acceptance of these general conditions of sale.

Article 3 – Prices

Prices are indicated in euros, all taxes included (VAT 20% where applicable), excluding shipping and handling costs.
Prices may change at any time. However, the price applied to an order is the one displayed at the time of purchase.

Article 4 – Payment

Payment is due immediately on the date of the order, including for pre-orders.
Payments are accepted via credit card (Visa or Mastercard). Cards issued by banks outside the European Union must be international bank cards.
American Express is not accepted.

Secure online payment is processed through Stripe (for credit card transactions) and PayPal (where available). Payment information is encrypted during transfer and cannot be read while in transit. Security guarantees are the responsibility of these providers and cannot be attributed to us.

Article 5 – Delivery

Delivery is made to the address specified at the time of the order. Please ensure accuracy, particularly for postal codes.
Delivery methods may include:
- Digital downloads: immediately after purchase, via email link or client account.
- Limited edition prints and original artworks: shipped to the physical address provided.
The risks transfer to the Client once the products leave our premises.
In the event of a lost or damaged package, we will take the necessary steps to ensure you receive your product or are reimbursed, in line with the applicable warranty.

Article 6 – Protection of Personal Data

In accordance with data protection regulations (including the South African Protection of Personal Information Act (POPIA) and the EU GDPR, where applicable), you have the right to access, rectify, or request the deletion of personal information concerning you.
By accepting these terms, you acknowledge having read our Privacy Policy and consent to our collection and use of your personal data.

When you provide your email address on one of our sites, you may receive informational and/or promotional emails about artworks, prints, or courses published by Createc Designs or our partners.

You may unsubscribe at any time by clicking the link at the end of our emails, which begins with: “To unsubscribe or change subscriber options visit:”

Our newsletter complies with applicable data protection regulations.

Article 7 – Refunds & Returns

Digital downloads: Due to their nature, all sales of digital art products are final and non-refundable.
Limited edition prints & original artworks: Returns are accepted within 14 days of receipt, provided the item is returned in perfect condition. Shipping costs are the responsibility of the Client unless the return is due to our error or product damage during transit.
Courses & workshops: Refunds are only granted if requested at least 7 days before the start date of the course or workshop.

Article 8 – Applicable Law

All clauses in these general conditions of sale, as well as all related purchase and sale operations, are governed by South African law. Where relevant, European consumer protection laws may also apply for international clients.
